Barley — Nightlife Discovery App. Operated by Outlier Estates LLC.

LanguageEnglish

1. Introduction and Scope

Barley (“the App”) is operated by Outlier Estates LLC (“we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Barley mobile application for iOS and Android, the website barleynightlife.com (including the Android waitlist and creator pages), and the share pages that the App generates. Please read this policy carefully. If you do not agree with it, do not use Barley.

2. Information We Collect

Account Information

When you create an account we collect the identifier you sign up with: your mobile phone number (verified with a one-time SMS code sent through Twilio), your Apple ID name and email (or Apple’s private relay address) when you use Sign in with Apple, your Google account name, email, and profile picture when you use Google Sign-In, or your email address and a password. Authentication is managed through Supabase Auth. You may also add a display name, profile photo, bio, and an optional birthday.

Location Data

Barley uses your device’s precise location to show nearby venues, rank them for tonight, and provide location-relevant recommendations. Location is collected only while the App is in use (never in the background) and only with your explicit permission. You can disable location access at any time in your device settings, though this will limit core App functionality.

Microphone and Voice Input

If you use the voice search, the App asks for microphone and speech-recognition permission. Your speech is transcribed on the device by your operating system’s speech service. We do not keep the audio recording. The transcribed text is sent to our servers and to Google Gemini as described in section 4, together with your current location, so it can be matched to venues. You can type instead of speaking at any time.

Preferences and Onboarding Answers

During setup you tell us what you are looking for: the kind of night, occasion, vibes you like, dealbreakers, and your city. We store these with your profile to personalize recommendations and you can change them later.

Camera, Photos, and User-Generated Content

With your permission, Barley accesses your camera and photo library so you can set a profile photo and, where the feature is available, post photos and videos. Content you create on Barley (posts, photos, videos, captions, comments, likes, follows, and night plans you choose to share) is public by default and visible to other users and to anyone with the share link.

Usage, Device, and Crash Data

We collect usage events such as the screens you open, searches you run, features you use, and the plan you choose, together with device information (model, operating system and version, app version, language, time zone, IP address, and an installation identifier). If the App crashes we receive a crash report with a technical trace, device details, and your account ID; we remove email addresses, phone numbers, and location from crash reports before they are sent.

Advertising Identifiers

The App does not collect the device advertising identifier (IDFA on iOS, Google Advertising ID on Android) and does not show an Apple tracking prompt, because it does not track you across other companies’ apps or websites. The Meta SDK in the App is configured with advertiser identifier collection switched off. On iOS we may receive the vendor identifier (IDFV), which identifies your device only to Barley. See section 6.

Push Notification Tokens

If you opt in, we collect your device’s push notification token to send you venue recommendations, social alerts, and, if you agreed to receive them, occasional offers. You can turn offers off in the App (Profile > Notifications) and turn all notifications off in your device settings.

Purchase Information

When you subscribe, Apple or Google processes the payment and sends us a receipt or purchase token, the plan, price, currency, renewal date, and status. We never see or store your payment card details.

Support and Feedback

When you contact us or send feedback from the App we receive your message, your email address, and basic device information so we can reply.

Website

What barleynightlife.com collects (analytics cookie, language preference, waitlist email, creator attribution) is described in section 9.

3. How We Use Your Information

  • Display and rank nearby venues based on your location and preferences
  • Turn your typed or spoken request into venue recommendations and night plans
  • Create and secure your account, verify your phone number, and prevent fraud and abuse
  • Enable you to create, share, and interact with content, and to report or block other users
  • Send push notifications you have opted in to
  • Process subscriptions and in-app purchases and provide customer support
  • Measure which marketing campaigns lead to installs and subscriptions (section 6)
  • Understand how the App and website are used, fix crashes, and improve them
  • Enforce our Terms of Service and comply with legal obligations

We do not use your information to make automated decisions that have legal or similarly significant effects on you.

4. Voice Input and AI Recommendations

Barley’s vibe search and night plans are generated with Google Gemini, a large language model operated by Google. When you run a search or build a plan we send Google the text of your request (typed or transcribed from your voice), your approximate location (coordinates, city, and neighborhood), and the candidate venue data needed to produce an answer. We do not send your name, phone number, email, or account identifier to Google. Google processes this data on our behalf under its API terms. We store your requests and the resulting recommendations with your account so we can show your history and improve results; they are deleted with your account. Feedback and feature requests you submit may also be screened by Gemini for abusive content before a person reads them.

5. Third-Party Services

We use the following service providers, each of which processes personal information only to provide its service to us and under its own privacy policy:

  • Supabase: database, file storage, authentication, and serverless functions (hosted in the United States)
  • Mapbox: map display; the Mapbox SDK also collects anonymized map-usage telemetry
  • RevenueCat: subscription management and purchase validation
  • Google Places and Foursquare: venue details, photos, hours, and ratings
  • Google Gemini: AI recommendations (section 4)
  • PostHog: product analytics for the App and website
  • Sentry: crash and performance reporting (with personal data scrubbed)
  • Meta (Facebook SDK): aggregated measurement of Barley’s own ads, without the advertising identifier (section 6)
  • Twilio: one-time SMS verification codes
  • Resend: transactional email (account emails, feedback replies, waitlist emails)
  • Expo: push notification delivery
  • Apple (App Store, Sign in with Apple) and Google (Google Play, Google Sign-In): payments, sign-in, and app distribution
  • Vercel: hosting for barleynightlife.com and the share pages, including short-lived server logs with IP addresses

We encourage you to review the privacy policies of these services. We do not control and are not responsible for their privacy practices beyond the contracts we have with them.

6. Advertising, Attribution, and Tracking

Barley does not show third-party advertising inside the App, and the App does not track you across other companies’ apps and websites. We do advertise Barley on Meta’s platforms (Facebook and Instagram), and to measure whether those ads work the App includes the Meta SDK with automatic app event logging switched on. Meta receives app events such as install, app open, account registration, and subscription purchase, together with basic device information (model, operating system, app version, language, time zone, and IP address). Advertiser identifier collection is switched off, so Meta does not receive your IDFA or Google Advertising ID from the App. Meta uses these events to report aggregated results for Barley’s own ad campaigns. You can limit how Meta personalizes ads to you in your Facebook or Instagram account settings (Settings > Accounts Center > Ad preferences).

iOS

The App does not request permission to track and does not show Apple’s App Tracking Transparency prompt. Install measurement for Apple campaigns is limited to Apple’s privacy-preserving SKAdNetwork, which reports only aggregated results and no device identifier.

Android

On Android the App declares the Google Play advertising ID permission because the Meta SDK requires it, but the App does not read your Google Advertising ID for tracking or share it with Meta. You can still reset or delete the identifier in Settings > Google > Ads (on some devices Settings > Privacy > Ads).

The website uses no advertising pixels. Creator and campaign links carry a random click ID so an install can be credited to the right creator; that ID is not an advertising identifier.

7. Subscriptions & Payments

Barley is a paid membership app; access to its features requires a subscription managed through RevenueCat. All payment processing is handled by the Apple App Store or Google Play. We do not collect or store your payment card information. Subscriptions renew automatically until canceled; manage or cancel them in your Apple ID settings (Settings > Subscriptions) or in Google Play (Subscriptions). See section 8 of the Terms of Service.

8. Data Sharing

We do not sell your personal information. We share information only in these circumstances:

  • With the service providers listed in section 5, solely so they can provide their services to us
  • With Meta, as aggregated app events without your advertising identifier, to measure Barley’s own ads (section 6)
  • With other users and the public, for content you choose to post or share
  • When required by law, court order, or governmental authority
  • To protect the rights, safety, or property of Barley, our users, or the public
  • In connection with a merger, acquisition, or sale of assets, in which case this policy continues to apply

9. Website, Cookies, and Local Storage

Analytics cookie

barleynightlife.com uses PostHog to understand how visitors use the site: which pages and buttons are used, which campaign or creator link brought you here, your device type, language, and browser, plus your IP address and a random visitor ID. PostHog sets one cookie (named ph_…_posthog) and a matching entry in your browser’s local storage so that visits can be counted once. We do not record your screen or capture what you type. Session recording is switched off in code.

If you visit from the European Economic Area, the United Kingdom, or Switzerland, this analytics cookie is set only after you choose Accept in the cookie banner; Decline is just as easy, and both choices are remembered in your browser. Elsewhere, analytics runs by default and you can switch it off at any time with the Cookie choices link in the site footer or by clearing site data in your browser.

Strictly necessary storage

We store your language choice in local storage (barley.site-locale.v1) so the site opens in your language. Creator pages keep a random click ID in session storage for the length of your visit so a download can be credited to the creator.

Creator links

When you open a creator page, we record the click ID, the creator and campaign, the page you landed on, any UTM parameters, and the website that referred you. Our server stores a hashed (one-way) form of your IP address, never the address itself. For visitors who must consent to analytics (above), this is recorded only after you accept.

Android waitlist

If you join the Android waitlist we store your email address with Resend so we can send you one email when Barley is available on Google Play. Every email we send includes an unsubscribe link and our postal address. We do not sell or rent waitlist emails and we do not use them for any other marketing.

Hosting

The website is served by Vercel, which keeps short-lived request logs (IP address, user agent, URL) for security and operations.

10. Data Retention & Deletion

We keep your account information, preferences, content, and search history for as long as your account is active. Purchase records are kept for as long as your subscription is active and afterwards for as long as tax and accounting rules require. Analytics and crash data are kept for as long as needed to understand and improve the App and are then deleted or de-identified. Server and security logs are kept for a short period. Phone numbers are kept only as your sign-in credential and the verification code itself expires within minutes.

You can delete your account at any time in the App: open Profile, choose Delete account, and confirm. This permanently removes your profile, preferences, posts, saved spots, plans, search history, push token, and the analytics events tied to your account from our active systems, and we instruct PostHog to delete your event history. Copies in encrypted backups roll off on their normal schedule, and we may keep limited records where the law requires it (for example, purchase records and fraud-prevention data).

If you cannot access the App, request deletion by emailing jake@barleynightlife.com from the address or phone number on the account (see also Barley Support). Deleting your account does not cancel a store subscription; cancel it in the App Store or Google Play first.

11. Data Security

We implement industry-standard security measures to protect your data, including encryption in transit and at rest, and access controls. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security. If we learn of a breach that affects you we will notify you and the relevant authorities as the law requires.

12. Age Requirement and Children’s Privacy

Barley is for adults. You must be at least 18 years old to use it, and the venues it shows are often open only to people of legal drinking age (21 in the United States), so where alcohol laws apply you must also meet that age. Barley is not directed at anyone under 18 and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a user under 18 we will promptly delete it and close the account. If you are a parent or guardian and believe your child has provided us with personal information, contact us at jake@barleynightlife.com and we will delete it.

13. Your Rights in the EEA, UK, and Switzerland

If you are in the European Economic Area, the United Kingdom, or Switzerland, the data controller is Outlier Estates LLC, [POSTAL ADDRESS], California, United States. We have not appointed a data protection officer; our privacy contact is jake@barleynightlife.com.

Legal bases

  • Performance of a contract: creating your account, providing the App’s features, processing your subscription, and support.
  • Consent: precise location, microphone and speech recognition, offer notifications, the website analytics cookie, and the Android waitlist email. You can withdraw consent at any time through the device or App settings described in this policy or by contacting us; withdrawal does not affect processing that already happened.
  • Legitimate interests: keeping the App secure, preventing fraud and abuse, measuring campaigns with non-identifying data, fixing crashes, and improving the App, balanced against your rights.
  • Legal obligation: keeping purchase records and responding to lawful requests.

Your rights

You have the right to access the personal data we hold about you, to have it corrected, to have it erased, to restrict or object to its processing, to receive it in a portable format, and to withdraw consent. To exercise these rights, email jake@barleynightlife.com; we will respond within one month and may ask you to verify your identity. You also have the right to lodge a complaint with your national data protection authority (in the UK, the Information Commissioner’s Office at ico.org.uk; in the EEA, the authority of the country where you live or work).

International transfers

Barley is operated from the United States and our service providers process data there and in other countries. Where data leaves the EEA, UK, or Switzerland we rely on the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum with our providers, and, where a provider is certified, the EU-US, UK, and Swiss-US Data Privacy Framework.

Retention

The retention periods in section 10 apply.

14. Your Rights (CCPA, California Residents)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):

  • Right to Know: You may request details about the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the third parties we share it with.
  • Right to Delete: You may request deletion of your personal information, subject to certain exceptions. The in-app deletion path in section 10 is the fastest way.
  • Right to Correct: You may ask us to correct inaccurate personal information.
  • Right to Opt Out of Sale or Sharing: We do not sell personal information. The App sends Meta app events for measuring Barley’s own ads without your advertising identifier (section 6); to the extent this counts as “sharing” under California law, you can opt out by emailing jake@barleynightlife.com, which we treat as a “Do Not Sell or Share” request, and you can limit ad personalization in your Meta account settings.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

To exercise these rights, contact us at jake@barleynightlife.com. An authorized agent may submit a request on your behalf with your written permission.

15. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy within the App or on our website, and where the change is significant we will ask for your consent again if the law requires it. Your continued use of Barley after changes are posted constitutes acceptance of the revised policy.

16. Contact Us

If you have questions about this Privacy Policy or wish to exercise your data rights, please contact us at jake@barleynightlife.com.
